These terms and conditions (the “Terms and Conditions”) are the terms and conditions upon which Wrapyard.com (“we/us/our”) make this website (the “Wrapyard.com”) available to you and any of our services which are accessible on or via the Wrapyard.com site (the ” Wrapyard.com Services”). By ordering on Wrapyard.com, you agree to be fully bound to and have accepted the following terms & conditions and delivery policy and will adhere to them unconditionally. These terms & conditions will be shown on checkout, and also clearly shared in every email communication regarding order processing, order shipment and any other email updates.

1. Gift Products

1.1 All products as described by their product descriptions on this website (as may be varied from time to time) are available for every city of the respective country under which the product is displayed. Certain product ranges are available in selected delivery areas only and such information is given in the respective product pages.

1.2 Some flower and plant products may be harmful or poisonous (lilies in particular can be extremely toxic to cats), if you require further information before submitting an order please contact our Customer Service.

1.3 All products are subject to availability. In the event of any supply difficulties, we reserve the right to substitute with a product of equivalent value and quality, if the same is unavailable after order confirmation notification.

1.4 All gift baskets, gift hampers, gift boxes, gift bags & gift sets sold on Wrapyard.com are assembled by local suppliers in or near the recipient country of your choice. These third-party suppliers will also be responsible for the shipping and delivery. The supplier will ship the gift products based on the hamper or basket description (food, spa, chocolates, flowers) chosen and ordered by the client and will ship the gift products in line with the product descriptions of the selected gift basket, to be delivered to the recipient. By placing your order, you confirm to have read and accepted the product descriptions and have accepted them unconditionally.

1.5 Wrapyard.com does not intervene or has any control over the chosen gifts as these are carefully selected by local experts and craftsmen either in or near the recipient country and cannot be held liable for any difference between the buyer’s expectations and the delivered gift products. By ordering & buying the gift baskets the client agrees that the basket will be assembled with gifts chosen by the local supplier and agrees fully that Wrapyard.com shall not be held accountable for any deviation regarding the client expectations and the delivered Gift Set, Gift Basket, Gift Hamper or Gift Box.

1.6 All images and illustrations of gift hampers & gift baskets shown are purely indications of similar gift baskets that have been delivered and this is clearly mentioned on the product pages and the final product photo. The actual gift might deviate from these illustrations but will stay in line with the product description. As clearly stated in the product description on every product page, Wrapyard reserves the right to substitute certain products based on availability, recipient country & import regulations. This notice is also clearly mentioned on every product page and by placing an order for the gift sets, the client agrees to have read and agreed to this. Wrapyard shall in no way be held liable for any complaints arising from the buyer who has not read or taken notice of the product description or the clear remarks about the illustrations, as they have confirmed to agree fully with the product description and T&C.

1.7 Multiple products in one order for a single recipient may be combined in one larger gift box or gift hamper to assure safe delivery and transportation.

1.8 Wrapyard.com does not make any claim towards a certain quality, brand of origin of any product as these are selected by local suppliers. Any visuals containing brands are as clearly mentioned on the product page purely indications.

1.9 In case gift baskets containing alcoholic products were selected, we reserve the right to substitute these products for certain countries based on our ‘alcoholic gift policy page’. 2. Prices

2.1 Prices listed within the Wrapyard.com Service are valid for a maximum of 14 days of submitting your order.

2.2 All prices are free of VAT/GST unless otherwise specified.

2.3 All prices include shipping unless otherwise specified. Import fees, customs & duties if any are displayed on the final checkout screen.

2.4 The prices displayed on the website are quoted in either USD or EUR unless otherwise stated (certain countries will be able to purchase in their local currencies) and are valid and effective worldwide.
Prices & Delivery costs are subject to change but shall not affect orders that has already been placed, processed, and dispatched prior to the change. Prices are subject to VAT and are exclusive delivery costs, which are automatically shown and added in the total amount when you view your items in the shopping basket or on the checkout page, once have selected your chosen delivery method. If no delivery costs are shown, these order includes free shipping.

3. Orders / Payment / Tracking

3.1 While to checkout (place the order), you will be required to provide us with a few personal details, including the phone number and/or email id, along with those of the intended recipient and all necessary payment details. This is to ensure the order can be successfully delivered. All data gathered can be removed upon request under GDPR regulations.

3.2 We accept payment by Visa, Master, Amex & Discover and all major credit cards, Google Checkout, GT Pay.

3.3 By clicking on the ‘place order’ button at the end of the order process, you are consenting to be bound by our terms and conditions unconditionally contained in these Terms and Conditions, appearing anywhere on the Wrapyard.com site and referred to in the footer of automated email communication from our platform.

3.4 Submitting your order is subject to our acceptance of this offer. We will send an email confirmation of your order details to advise that we are processing your order via the email address you provide.

3.5 Payments on all orders shall be made by any of the provided payment methods (such as visa, mastercard, …) and are subject to validation checks & pre-authorization by the card issuer. Wrapyard.com is not responsible for card refusal and any online handling fees that may be charged by the card issuer. Orders that have been processed and are in transit or are experiencing delivery delays are no longer eligible for refunds.

3.6 For any deliveries using third-party courier services offering tracking, or when you have selected and paid for the additional ‘track shipping’ option: Wrapyard.com will provide available tracking & shipping codes only when tracking codes are available, in case your gift has been shipped with a provider offering these tracking services (DHL, TNT, Nordpost, PostNL, PostBE, …). These codes will be available only when the courier has picked up the gift and your order is processed it in the central warehouse. Tracking codes are available 1-2 days after order processing and can be requested our customer support.

3.7 For deliveries made by hand courier or from one of our online marketplaces (FBA, Japanese Post, ..), tracking codes are not available as part of their service and the client will be informed on status of their order via email updates from our platform. These updates can be consulted via the accounts & track order page. By placing your order, you agree to to be bound unconditionally to these Terms & Conditions and accept email updates as valid and concluding proof of tracking and delivery status.

4. Delivery

4.1 Selected products may not be available for delivery to certain localities (such as consumable products, foods, alcohols, etc.). We try our best to provide with such information either on the respective product page, during checkout or will communicate you after you place your order. If you did order a product that is not available for delivery for a certain location, we reserve the right to substitute with a product of equivalent value and quality, and you will be notified of this.

4.2 We do not recommend courier deliveries to hospitals, short-term recipients at hotels or funerals. Any order placed requires a recipient to be present for delivery and failure to accept the package will not give any right for refund or compensation.

4.3 Shipping Methods – If you wish a delivery to be made within a specific time period, you can note the respective shipping method upon order checkout in the notes field. Wrapyard.com will try to take these requests into regard upon processing of the order, but is not bound to these requests. The shipping duration and range shown on the checkout screen cannot be shortened and should be considered as minimum duration. Please note that some shipping methods are subject to availability and that at certain times of the year the charges for the service may vary. The information and the available shipping methods is always provided on the respective product pages when you place your order.

4.4 Deliveries via courier services cannot be delivered at specific times. All orders will be delivered during the working day between 10am to 7pm (in the recipient time zone) during normal days (exceptions are such high gifting days like Valentine’s day, Mother’s day, etc during which deliveries can happen beyond this time range).

4.5 Deliveries are available only on the days and times that courier & postal services are active and Wrapyard.com does not control these services. Please contact our customer service team if you need any suggestions on any other gifts that may be available for your choice day.

4.6 To avoid problems or delays with delivery, please ensure that you have provided with the full address details, including accurate postcode of the recipient and telephone number so that it would be easy for our delivery services to locate them. It would also be very helpful if you provide us with your daytime contact telephone number or e-mail address so that we can notify you in the event that any delivery problems are encountered.

4.7 Certain products cannot be delivered on a specific delivery date, but will be delivered during a delivery period (for eg., delivery in 2-4 business days or 3-7 business days, etc.). The estimated time it takes for such products to be delivered is shown on the respective product page near the shipping method area. Please contact our customer service for any questions you may have about delivery dates for such products.

4.8 Whilst we agree to use all reasonable endeavors to ensure that delivery will be on the requested delivery date or during the delivery period, you acknowledge that actual delivery will be via our local distributors or for certain orders via third party courier service and that Wrapyard.com will under no circumstances be held accountable for any delays or delivery disruptions of any kind.

4.9 In the case of delivery to certain locations, where a third party is involved, such as prisons, guarded offices, hospitals, funeral directors, airports, hotels, ships and other business locations, the signature of any person authorized to accept delivery on behalf of the organization shall be accepted as proof of delivery to your chosen recipient.

4.10 Please be aware that the carrier will deliver the goods to the address provided in good faith and we cannot accept responsibility if the intended recipient is no longer at that address or not able to receive the gift in any way, or if the receiver refuses to accept the gift or fails to return the items.

4.11 Wrapyard.com advices against placing time-pressured orders to hotels & resort guests or traveling recipients as various reasons could impact delivery. By placing your order, you accept any risks and agree that we will not be held accountable for the recipient not being present.

4.12 Please note that where the carrier is unable to find someone to accept delivery, or unable to leave the delivery in a secure location, they will leave a card at the address for the recipient to make contact and re-arrange delivery. If the recipient fails to make contact in good time we reserve the right to charge for re-delivery to that or an alternative address.

4.13 Please note that if you order a number of items for delivery to the same address, they may be dispatched separately and we cannot guarantee delivery on the same day/time.

4.14 We shall not be liable for any failure to perform in our obligations where such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster such as pandemics), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service.

4.15 Confirmation of delivery on the third-party courier tracking platform shall be accepted as valid proof of delivery, no additional signatures are required.

4.16 While we always aim to have products delivered to the recipients address, it is the local courier provider (DHL, TNT, PostFR, Posti, NordPost, PostNL,…) who will deliver the package as close to the recipient as possible based on the courier options for the selected destination. For remote and isolated regions, desserts, islands with single post offices and unreachable destinations, the courier may choose to leave the package at the closest available pick-up point and notify the recipient for pick-up. Wrapyard.com has no control over courier delivery methods and shall not be responsible or held liable for any packages that require additional efforts. In this case, tracking information and Pick-up instructions will be shared by the courier to the recipient and will be valid proof of fulfillment of the gift order.

4.17 Shipping & Delivery times can be impacted by various factors such as force majeure & worldwide events (f.e. Covid-19, strikes & natural disaster). Wrapyard.com will not issue refunds or compensation for gifts delayed or lost by force majeure.

5. Order Cancellation

If, for any reason, you wish to change or cancel your order you can do so:

Such requests for cancellation/amendment are processed subject to the request before cut-off time (the time before which the order is processed/prepared).

Please note that changes or cancellations may carry additional costs.

5.1 We regret that orders cannot be canceled once processed.

5.2 You are entitled to cancel any payment at any time where fraudulent use has been made of your credit or debit card by another person not acting on behalf of you or as your agent and to be re-credited by us to the extent that such sums are not reimbursed by the card issuer in such circumstances.

7. General

7.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Wrapyard.com site and/or the Wrapyard.com Services from time to time. We will post any changes on the Wrapyard.com. site and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Wrapyard.com Services or Wrapyard.com site. Changes will be effective five (5) hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.

7.2 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Wrapyard.com site, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

7.3 We will only use the personal data (of you and of the recipient) provided by you for the purpose of fulfilling our obligations under these Terms and Conditions and as stated in our Privacy Policy.

7.4 A person who is not a party to the agreement between you and us has no rights to enforce any of the Terms and Conditions.

7.5 In respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.

8. Intellectual Property

8.1 All other rights, including copyright, in this website are owned by Wrapyard.com. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non commercial use is prohibited without the permission of Wrapyard.com. You may not modify, distribute or repost something on this website for any purpose.

9. My Account service

9.1 To register with any of the Wrapyard.com Services, you must be over eighteen years of age.

9.2 You are advised to change the automated password (as soon as possible from the time of you receiving it) that our Wrapyard.com Service generates. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us immediately. Please use our Forgot Password service if you have forgot the same.

9.3 If Wrapyard.com has a reason to believe that there is likely to be a breach of security or misuse of the Service or site, we may require you to change your password, or may suspend the use of our Service.

9.4 You must ensure that the details you provide on registration or at any time are correct and complete.

9.5 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details. You can update the details you have given us at any time by going to the ‘Edit Profile’ section of the ‘My Account’ area of the website. This will ensure that the Service we provide is accurate and up to date. Please also visit this page OR email us if any of the information that we hold about you is incorrect or needs updating, or if you want us to delete any personal information.

9.6 Use of the Service is intended to assist with purchases to be made via the site. The Service must not be used for the following purposes:

  • Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
  • Gaining unauthorised access to other computer systems.
  • Interfering with any other person’s use or enjoyment of the Site.

9.7 Wrapyard.com reserves the right to refuse to post material on the Site, or to remove material already posted on the Site.

9.8 Whilst we take every reasonable precaution and care in relation to the Service, we do not make any representation or warranties of any kind (express or implied) with respect to the contents or operation of this Service, and any such representations and warranties are excluded by this notice. We do not warrant that use of the Service will be uninterrupted or error free. Whilst every effort is made to ensure reminder emails set up on your account are processed and delivered as requested, we cannot be held responsible for non-delivery of these messages. Your use of the Service is done so entirely at your own risk and we do not accept any liability whatsoever for losses or damages that you may suffer as a result of your use of the Service.

These Terms and Conditions operate in conjunction with general Terms & Conditions of the Site governing overall use and order placement. We are committed to protecting your privacy, further information is contained within our Privacy Policy.

10. Refund Policy

10.1 At Wrapyard.com , we have a friendly refund policy to ensure your online purchase is hassle-free and we make every effort to ensure that you receive excellent service. All orders that have been placed but not yet processed are eligible for refund. Any processing fees & payment transfer fees (such as Stripe, PayPal etc) will be deducted from the refund.

10.2 We regret that you may not cancel an order once your order is processed. Refunds will not be given under any of the following circumstances:

  • Any orders once they have been processed by Wrapyard.com (5.1). From this point on they are with the third-party courier for delivery. The client will receive a confirmation order when the order has been processed.
  • Orders wherein a similar gifting product or gift basket was found or sold at another vendor or platform for a different price. We do not offer lowest-price guarantee as we provide gifting services, not just products.
  • Any orders experiencing any form of delay (4.8) or disruption of delivery (held at customs, issues with delivery, recipient not being reachable or unable to pick up the order).
  • Any orders affected by Force Majeure (4.13 – 4.15)
  • Any orders that were substituted (1.3 – 4.1) or gift baskets that were assembled be design of the third party supplier that do not meet the expectations of the client (12.2).

11. Complaint process

11.1 At Wrapyard.com , we make every effort to ensure that customer support resolve the customer issues fast and impeccable. Customer can raise their complaints and questions by sending email to info@wrapyard.com within 14 days from the delivery date. After this period, the order is deemed fully accepted and no further complaints or dispute will be valid.

11.2 In case of any delivery issues, we request customers to send photos of the product’s received and Order details. Please note that after 30 days, most courier tracking information will no longer be available to help trace delivery.

12. Limitations of Liability

12.1 Wrapyard.com shall not be held liable for lost packages, delivery delays & problems, and defective items. Wrapyard.com shall not be held liable for any consequences, resulting directly or indirectly from any gift delivery experience ordered from the website. Wrapyard.com works with third party couriers & suppliers who provides all information, photos, descriptions and details about the products and gift sets.

These terms & conditions will be mentioned both on the process confirmation email you receive upon ordering as well as on the order completion mail you will receive when the order has been processed & shipped.
